In plain language

These are the rules for shopping at Plushy Mochi. In short: be honest when you order, read the age and safety notes on each product, and reach out if anything goes wrong. We'll do our best to make it right. These Terms are governed by Florida law.

Who we are

Plushy Mochi (the "Store"), available at plushymochi.com, is owned and operated by Cacele Digital, LLC, a Florida limited liability company located at 4475 US-1 South, Suite 604, St. Augustine, Florida 32086, United States ("Plushy Mochi", "Cacele", "we", "our", "us"). These Terms of Service ("Terms") apply to your use of the Store and to every purchase you make from it.

Accepting these Terms

By visiting the Store, creating an account or placing an order, you agree to these Terms and to our Privacy Policy, Refund & Return Policy and Shipping Policy, which are part of these Terms. If you do not agree, please do not use the Store.

You must be at least 18 years old, or the age of majority where you live, to place an order. Younger shoppers may browse and pick out favorites, but a parent or guardian must place the order.

Products and descriptions

We work hard to describe and photograph every pal accurately. Plush toys are handmade or hand-finished, so sizes may vary slightly (usually by about 1 to 3 cm) and colors may look a little different on your screen. Product photos may show styling props that are not included. If what arrives is not what was described, see our Refund & Return Policy.

Product safety

Your safety, and the safety of the little ones in your life, matters to us. Please:

• Read the age guidance and warnings on the product page and packaging before giving a product to a child.
• Keep keychains, bag charms, coin purses, magnets, small squishies and any item with small parts, clips, rings or cords away from children under 3. They can be a choking hazard.
• Keep magnets away from young children. Swallowed magnets can cause serious injury; seek medical attention right away if a magnet is swallowed.
• Remove all packaging and tags before giving a plush to a child, and supervise young children during play.
• Inspect toys regularly and stop using any toy that is torn, leaking stuffing or has loose parts.
• Squishy and stress toys are not food. Keep them away from heat and do not chew them.

Keychains, bag charms, coin purses, magnets and decorative items are accessories, not toys for young children.

Orders

When you place an order you are making an offer to buy. Your order is accepted when we send a shipping confirmation, not when you receive an order confirmation email. We may decline or cancel an order, or limit quantities, for example if an item is out of stock, a price or description was listed in error, we cannot verify payment or we suspect fraud or reselling. If we cancel an order after you have been charged, we will refund you in full.

If you need to change or cancel an order, email us as soon as possible. Once an order has been packed or shipped we may not be able to change or cancel it. See our Refund Policy if an order arrives damaged or is the wrong item.

Prices, payment and taxes

Prices are shown in US dollars unless your local currency is displayed at checkout. Prices, products and promotions can change at any time without notice, but changes will not affect orders we have already accepted. Applicable sales tax is calculated at checkout. For international orders, duties and import taxes may apply as described in our Shipping Policy.

Payments are processed securely by Shopify Payments and the other payment providers shown at checkout. By submitting payment you confirm that you are authorized to use that payment method.

Discount codes, promotions and gift cards

Discount codes and promotions are valid only for the period and on the terms stated, cannot be combined unless we say so, have no cash value and may be withdrawn at any time. We may cancel orders that use codes obtained or used improperly. Gift cards are not redeemable for cash except where required by law, and lost or stolen gift cards cannot be replaced.

Shipping, title and risk of loss

Delivery estimates are not guarantees. See our Shipping Policy for processing times, delivery times and what to do if a package is late, lost or damaged. Title to products and risk of loss pass to you when the package is delivered to the shipping address you provided.

Returns and refunds

Returns, exchanges and refunds are governed by our Refund & Return Policy.

Accounts

If you create an account, please keep your login details private and tell us right away if you think someone else is using your account. You are responsible for activity on your account. We may suspend or close accounts that violate these Terms.

Reviews, photos and messages

If you send us reviews, photos, ideas or other content, you confirm that you have the right to share it and you give us a non-exclusive, royalty-free, worldwide license to use, display and share it to run and promote the Store. We may remove content that is unlawful, offensive or misleading. We won't post your full name without permission.

Our content

The Plushy Mochi name and logo, our mascot, photos, videos, product descriptions, designs and site code belong to Cacele Digital, LLC or our licensors and are protected by intellectual property laws. You may share links to the Store, but please do not copy, sell or reuse our content without written permission. Other brand names mentioned on the Store belong to their owners.

Things you can't do

• Use the Store for anything unlawful, fraudulent or harmful.
• Scrape, copy or harvest content or data from the Store, or interfere with its security or operation.
• Buy products for unauthorized commercial resale or misuse our promotions.
• Impersonate anyone or give false information when ordering.

Third-party links and services

The Store may link to or rely on third-party websites and services (such as payment providers, carriers and social media). We are not responsible for their content or practices, and your use of them is subject to their own terms.

Disclaimers

We want every pal to arrive happy and huggable, and we stand behind our products as described in our Refund & Return Policy. Otherwise, to the fullest extent permitted by law, the Store and all products are provided "as is" and "as available", and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Nothing in these Terms limits any rights you have as a consumer that cannot be limited by law.

Limitation of liability

To the fullest extent permitted by law, Cacele Digital, LLC and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Store or products bought from it. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. These limits do not apply to liability that cannot be limited by law, such as liability for personal injury caused by our negligence.

Indemnification

You agree to indemnify and hold Cacele Digital, LLC harmless from claims arising from your misuse of the Store, your violation of these Terms or your violation of anyone else's rights.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws rules. Please contact us first so we can try to resolve any concern informally. Any dispute that cannot be resolved will be brought in the state or federal courts located in St. Johns County, Florida, and you and we consent to that jurisdiction, except that either of us may bring an individual claim in small claims court where eligible. If you live outside the United States, you may also have rights under the mandatory consumer laws of your country.

Changes and severability

We may update these Terms from time to time. The current version will always be on this page with its "Last updated" date. Changes apply to orders placed after they are posted. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver.
